Terms of service.

Welcome to Fillam (“Fillam”, “we”, “us”, “our”). These Terms govern your access to and use of the Fillam mobile app, website, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
1) Who we are & contract formation
Fillam is operated by Fillam Solutions Private Limited, having its registered office at Block 10, Flat 806, AVL36, Sector 36A, Gurgaon 122004, Haryana. These Terms form a binding agreement between you and the Company. We may update these Terms at any time; changes take effect when posted on the Platform.Continued use means you accept the updated Terms.
2) Eligibility & account
• You must be at least 18 years old and legally competent to contract in India.
• You are responsible for the accuracy of information provided, maintaining the confidentiality of your credentials, and for all activity under your account.
• We may refuse, suspend, or terminate accounts at our discretion (including for violations of these Terms or applicable law).
3) Nature of the Platform; intermediary status
Fillam is a social networking platform focused on films, enabling users to connect, recommend, review and engage in discussions about movies, shows and related contents. We are an “intermediary” under Section 79 of the Information Technology Act, 2000 and are not the publisher of user content. Subject to the due-diligence obligations prescribed by law, intermediaries have “safe-harbour” protection for third-party content.
4) Your content & licence to Fillam
• Ownership. You retain ownership of content you submit (“User Content”), and you represent you have all rights required to post it.
• Licence. You grant Fillam a non-exclusive, worldwide, royalty-free licence to host, store,
reproduce, adapt, publish, display, and distribute your User Content on/through the Platform and our marketing channels solely to operate and promote the Platform. This licence ends when you delete the content or your account, except where (i) content has been shared with others who have not deleted it, or (ii) we must retain it for legal reasons.
• Feedback. Ideas/suggestions you share may be used without obligation to you.
5) Prohibited content & conduct
You agree not to post, share, or do anything that:
a) violates law, third-party rights (privacy, publicity, IP), or court/government orders;
b) is obscene, sexually explicit, exploitative of minors, hateful, harassing, defamatory, misleading, fraudulent, impersonates another, threatens public order/national security, or promotes self-harm/illegal activity;
c) contains malware, automated scripts/bots to scrape, harvest, or overload our systems;
d) circumvents access controls, or interferes with the Platform’s security or operations;
e) solicits or distributes others’ personal data without consent.
6) Moderation; use of automated tools
We use a layered approach—automated tools and human review—to detect policy-violating content. Automated outputs may be imperfect; where required, human moderators review escalations. We may remove or restrict content/accounts; apply visibility limits; or notify law enforcement where legally mandated.
7) Notice-and-takedown; user appeals
• Reporting. Use [in-app reporting] or email [Email address] to report content or conduct that
violates these Terms or law.
• Takedown. On receiving actual knowledge (via court/authority order or valid user notice) of
unlawful content, we act in accordance with applicable law and our policies.
• Appeals. If your content is removed or account restricted, you may appeal via [appeals link/email].
Where applicable, you may escalate to the Grievance Appellate Committee constituted by the
Government of India.
8) Grievance officer (mandatory India requirement)

The Grievance Officer acknowledges complaints within 24 hours and resolves them within 15 days of receipt, in line with the Intermediary Guidelines.
9) Copyright & IP policy (repeat-infringer)
• IP complaints. If you believe content infringes your copyright or other IP, send a detailed notice to [email address] (include work asserted, infringing URLs, proof of ownership/authority, your contact info, and a good-faith statement).
• Counter-notice. Users may submit counter-notices with sufficient detail.
• Repeat-infringer policy. We may terminate accounts of users who are repeat infringers.
10) Third-party services & links
The Platform may link to third-party sites, SDKs, or services (e.g., payment gateways, login providers, analytics). We do not control or endorse them and are not responsible for their content or practices. Your use is governed by those third parties’ terms and privacy policies.
11) Payments, subscriptions, and refunds (if applicable)
• Fees. Some features may be paid. Prices and taxes (including GST) are shown at checkout.
• Billing. By purchasing, you authorize us or our payment processors to charge your selected
payment method.
• Auto-renewal. Subscriptions renew automatically unless canceled before the renewal date in your app-store settings or Fillam account (as applicable).
• Refunds. Except where required by law or our specific refund policy stated at purchase, all fees are non-refundable and non-transferable.
• Payment gateways. Payment processing is performed by third-party gateways; gateway
errors/charges are outside our control.
12) Community interactions & safety
• We do not conduct criminal background checks and do not guarantee the identity of any user.
Exercise common sense and caution in online or offline interactions.
• Offline meetups or events are at your own risk. Fillam is not responsible for user conduct.
13) Data protection note (legal cross-reference)
Handling of personal data (including any Sensitive Personal Data or Information such as passwords or financial information, if collected) is governed by our Privacy Policy. Under Section 43A of the IT Act and the SPDI Rules 2011, entities handling SPDI must implement “reasonable security practices and procedures” (e.g., an information security management system such as ISO/IEC 27001).
14) Consumer & e-commerce disclosures (if/when Fillam offers marketplace/e-commerce
features)
If Fillam enables transactions or listings, we will comply with applicable requirements under the Consumer Protection (E-Commerce) Rules, 2020 (e.g., disclosure, seller information, and grievance redressal). Timelines thereunder differ from the IT intermediary rules and may require acknowledgement within 48 hours and resolution within 1 month for consumer complaints.
15) App stores & device terms
Your app-store (e.g., Apple App Store/Google Play) may impose additional terms. Where there is a conflict, the store terms govern your relationship with the store; these Terms govern your relationship with Fillam.
16) Beta features & changes to the service
We may test experimental or beta features that could change, break, or be withdrawn. We may modify, suspend, or discontinue the Platform (in whole or part) at any time.
17) Disclaimers
The Platform is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, accuracy, or non-infringement). We do not guarantee uninterrupted or error-free service, or that content will be accurate or complete.
18) Limitation of liability
To the maximum extent permitted by law, Fillam and its directors, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Platform, even if advised of the possibility of such damages. Our aggregate liability will not exceed the greater of (i) the amounts you paid to Fillam in the 6 months preceding the claim or (ii) INR 5,000.
19) Indemnity
You agree to defend, indemnify, and hold harmless Fillam and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms or law; or (d) your violation of any third-party rights.
20) Termination
You may stop using the Platform at any time and may request account deletion. We may suspend or terminate access immediately for violations of these Terms, legal requirements, or risk to users/Platform. Certain provisions survive termination (e.g., licences granted, disclaimers, limitations, indemnity).
21) Governing law; jurisdiction; dispute resolution
These Terms are governed by the laws of India. Courts at Gurugram, Haryana shall have exclusive jurisdiction, subject to any mandatory arbitration/conciliation process required by applicable law.
22) Communications; consent
You consent to receive transactional communications (OTP, security, service updates) by email, in-app notifications, or SMS. Marketing communications will follow your preferences and applicable consent rules.
23) General terms
• Entire agreement. These Terms + Privacy Policy are the entire agreement.
• No waiver. Failure to enforce is not a waiver.
• Severability. If any provision is invalid, the remainder stays effective.
• Assignment. You may not assign these Terms; we may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for delays/failures due to events beyond reasonable control.
